SB 1137, as amended, Torres. School transportation: apportionments.
Existing law authorizes the governing board of a school district to provide for the transportation of pupils to and from school. Existing law, among other things, requires each school district or county office of education that provides transportation to receive the same home-to-school and special education transportation allowances that it received in the prior fiscal year and prohibits the transportation allowances from exceeding the prior year’s approved transportation costs, increased by the amount provided in the annual Budget Act.
This bill would require the Superintendent of Public Instruction, for the 2014-15 fiscal year to thebegin delete 2019-20end deletebegin insert 2020-21end insert
fiscal year, inclusive, to apportion to each school district, county office of education, entity providing services under a school transportation joint powers agreement, or a regional occupational center or program that provides pupil transportation an amount equal to a specified annually increasing percentage of its approved transportation costs for the prior fiscal year or 100% of its school transportation apportionment for thebegin delete priorend deletebegin insert 2013-14end insert fiscal year,begin insert adjusted as specified,end insert whichever is greater.

Section 41850.5 is added to the Education Code,

15(2) For the 2015-16 fiscal year, the Superintendent shall

regional occupational center or program that provides
19pupil transportation services an amount equal to 42 percent of its
20approved transportation costs for the prior fiscal year or 100 percent
21of its school transportation apportionment for the prior fiscal year,
22whichever is greater.
23(3) For the 2016-17 fiscal year, the Superintendent shall
24apportion to each school district, county office of education, entity
25providing services under a school transportation joint powers
26agreement, or regional occupational center or program that provides
27pupil transportation services an amount equal to 44 percent of its
28approved transportation costs for the prior fiscal year or 100 percent
29of its school transportation apportionment for the prior fiscal year,
30whichever is greater.
31(4) For the 2017-18 fiscal year, the Superintendent shall
32apportion to each school district, county office of education,
entity
33providing services under a school transportation joint powers
34agreement, or regional occupational center or program that provides
35pupil transportation services an amount equal to 46 percent of its
36approved transportation costs for the prior fiscal year or 100 percent
37of its school transportation apportionment for the prior fiscal year,
38whichever is greater.
P3 1(5) For the 2018-19 fiscal year, the Superintendent shall
2apportion to each school district, county office of education, entity
3providing services under a school transportation joint powers
4agreement, or regional occupational center or program that provides
5pupil transportation services an amount equal to 48 percent of its
6approved transportation costs for the prior fiscal year or 100 percent
7of its school transportation apportionment for the prior fiscal year,
8whichever is greater.
9(6) For the 2019-20 fiscal year, the
Superintendent shall
10apportion to each school district, county office of education, entity
11providing services under a school transportation joint powers
12agreement, or regional occupational center or program that provides
13pupil transportation services an amount equal to 50 percent of its
14approved transportation costs for the prior fiscal year or 100 percent
15of its school transportation apportionment for the prior fiscal year,
16whichever is greater.
17(1) For the 2014-15 fiscal year, 41 percent of its approved
18transportation costs for the prior fiscal year.
19(2) For the 2015-16 fiscal year, 42.5 percent of its approved
20
transportation costs for the prior fiscal year.
21(3) For the 2016-17 fiscal year, 44 percent of its approved
22transportation costs for the prior fiscal year.
23(4) For the 2017-18 fiscal year, 45.5 percent of its approved
24transportation costs for the prior fiscal year.
25(5) For the 2018-19 fiscal year, 47 percent of its approved
26transportation costs for the prior fiscal year.
27(6) For the 2019-20 fiscal year, 48.5 percent of its approved
28transportation costs for the prior fiscal year.
29(7) For the 2020-21 fiscal year, 50 percent of its approved
30transportation costs for the prior fiscal year.
31(b) Thebegin delete amounts apportioned pursuant to this sectionend deletebegin insert
2013-14
32fiscal year school transportation apportionment amount described
33in subdivision (a)end insert shall be adjusted by the percentage change in
34the annual average value of the Implicit Price Deflator for State
35and Local Government Purchases of Goods and Services for the
36United States, as published by the United States Department of
37Commerce for the 12-month period ending in the third quarter of
38the prior fiscal year. This percentage change shall be determined
39using the latest data available as of May 10 of the preceding fiscal
40year compared with
the annual average value of the same deflator
