An act to amend Sections 51930, 51931, 51936, 51937, 51938, and 51939 of, to add Section 51902 to, and to add Article 3.5 (commencing with Section 51934.5) to Chapter 5.6 of Part 28 of Division 4 of Title 2 of, the Education Code, relating to pupil instruction.

Existing law requires the Instructional Quality Commission, during the next revision of the publication “Health Framework for California Public Schools,” to consider developing, and recommending for adoption by the State Board of Education, a distinct category on mental health, as specified.

This bill would require the commission, during the next revision of that publication, to consider, develop, and recommend for adoption by the state board, a distinct category on dating violence, sexual abuse, and sex trafficking prevention education, as specified.

Existing law, the California Comprehensive Sexual Health and HIV/AIDS Prevention Education Act, authorizes school districts to provide comprehensive sexual health education, as defined, in kindergarten and grades 1 to 12, inclusive, and requires school districts to ensure that all pupils in grades 7 to 12, inclusive, receive HIV/AIDS prevention education, unless the pupil is excused, as specified.

This bill would also authorize a school district to provide dating violence, sexual abuse, and sex trafficking prevention education, as defined, and would require a school district that elects to offer this instruction to ensure that each pupil receives the instruction at least once in junior high or middle school, and at least once in high school. The bill would encourage school districts to collaborate with outside consultants with expertise in dating violence, sexual abuse, and sex trafficking prevention education in order to create school safety plans to address these issues. The bill would make conforming and nonsubstantive changes.

SECTION 1.  

Section 51902 is added to the Education Code,

During the next revision of the publication “Health
4Framework for California Public Schools” (health framework) the
5Instructional Quality Commission shall consider, develop, and
6recommend for adoption by the state board, a distinct category on
7dating violence, sexual abuse, and sex trafficking prevention
8education that includes, but is not limited to, all of the following:

9(a) Information on dating violence and sexual abuse, and
10discussion of prevention strategies and local resources for potential
11victims, including how to report an incident.

12(b) Discussion of healthy boundaries for familial and dating
13relationships; how to recognize potentially harmful and abusive
14relationships or dangerous dating situations; development of refusal
15skills to overcome peer pressure; and effective decisionmaking
16skills to avoid high-risk activities.

17(c) Information on sex trafficking, and the recruiting tactics of
18traffickers and peer recruiters, including recruitment through the
19Internet.

20(d) Discussion of legal aspects of sexual violence and sex
21trafficking under state and federal laws.

22(e) Discussion of how culture, mass media, and other people
23influence and desensitize our perceptions of dating violence, sexual
24abuse, and sex trafficking, including, but not limited to, stereotypes
25and myths regarding persons who have been abused or trafficked.
26This instruction shall emphasize compassion for persons who have
27suffered from abuse or trafficking, and encourage positive reentry
28experiences for survivors returning to the school system.

SEC. 2.  

Section 51930 of the Education Code is amended to

(a) This chapter shall be known and may be cited as
4the California Comprehensive Sexual Health and HIV/AIDS
5Prevention Education Act.

6(b) The purposes of this chapter are as follows:

7(1) To provide a pupil with the knowledge and skills necessary
8to protect his or her sexual and reproductive health from unintended
9pregnancy and sexually transmitted diseases.

10(2) To encourage a pupil to develop healthy attitudes concerning
11adolescent growth and development, body image, gender roles,
12sexual orientation, dating, marriage, and family.

14to protect himself or herself from dating violence, sexual abuse,
15and sex trafficking.

SEC. 3.  

Section 51931 of the Education Code is amended to

For the purposes of this chapter, the following
19definitions apply:

20(a) “Age appropriate” refers to topics, messages, and teaching
21methods suitable to particular ages or age groups of children and
22adolescents, based on developing cognitive, emotional, and
23behavioral capacity typical for the age or age group.

24(b) “Comprehensive sexual health education” means education
25regarding human development and sexuality, including education
26on pregnancy, family planning, and sexually transmitted diseases.

27(c) “Dating violence, sexual abuse, and sex trafficking
28prevention education” means instruction on the prevalence and
29nature of dating violence, sexual abuse, and sex trafficking,
30strategies to reduce their risk, and how to safely report an incident.

14Health Association, the American Academy of Pediatrics, and the
15American College of Obstetricians and Gynecologists.

SEC. 4.  

Article 3.5 (commencing with Section 51934.5) is
21added to Chapter 5.6 of Part 28 of Division 4 of Title 2 of the 22Education Code, to read:

51934.5.  

(a) A school district may provide dating violence,
28sexual abuse, and sex trafficking prevention education.

29(b) If a school district provides dating violence, sexual abuse,
30and sex trafficking prevention education, it shall ensure that the
31education is from instructors trained in the appropriate courses.
32The school district shall also ensure that each pupil receives this
33instruction at least once in junior high or middle school, and at
34least once in high school.

35(c) Dating violence, sexual abuse, and sex trafficking prevention
36education, whether taught by school district personnel or outside
37consultants, shall satisfy all of the criteria set forth in paragraphs
38(1) through (6), inclusive, of subdivision (b) of, and paragraphs
39(1) and (2) of subdivision (d) of, Section 51933.

40(d) Instruction and materials shall include the following:

P5    1(1) Information on dating violence and sexual abuse, and
2discussion of prevention strategies and local resources for potential
3victims, including how to report an incident.

4(2) Discussion of healthy boundaries for familial and dating

23available to school districts on the department’s Internet Web site.

(a) A school district is encouraged to collaborate
25with outside consultants with expertise in dating violence, sexual
26abuse, and sex trafficking prevention education in order to create
27a school safety plan to address the threat of dating violence, sexual
28abuse, and sex trafficking.

29(b) A school district is encouraged to collaborate with law
30enforcement on a referral protocol for high-risk pupils and minors.

31(c) In-service training may be conducted periodically to enable
32school district personnel to learn new developments in the
33understanding of dating violence, sexual abuse, and sex trafficking,
34and to receive instruction on current prevention efforts and
35methods. A school district is encouraged to include training on
36early identification and mandated reporting of dating violence,
37sexual abuse, and sex trafficking of pupils and minors.

SEC. 6.  

Section 51937 of the Education Code is amended to

It is the intent of the Legislature to encourage pupils
12to communicate with their parents or guardians about human

and to respect the rights of parents or
15guardians to supervise their children’s education on these subjects.
16The Legislature intends to create a streamlined process to make it
17easier for parents and guardians to review materials and evaluation
18tools related to comprehensive sexual healthbegin delete education andend delete
19begin insert education,end insert HIV/AIDS prevention education,begin insert and dating violence,
20sexual abuse, and sex trafficking prevention education,end insert
and, if they
21wish, to excuse their children from participation in all or part of
22that instruction or evaluation. The Legislature recognizes that while
23parents and guardians overwhelmingly support medically accurate,
24comprehensive sex education, parents and guardians have the
25ultimate responsibility for imparting values regarding human
26sexuality to their children.

SEC. 7.  

Section 51938 of the Education Code is amended to
28read:

51938.  

A parent or guardian of a pupil has the right to excuse
30their child from all or part of comprehensive sexual health
31education, HIV/AIDS prevention education,begin insert dating violence, sexual
32abuse, and sex trafficking prevention education,end insert
and assessments
33related to that education, as follows:

34(a) At the beginning of each school year, or, for a pupil who
35enrolls in a school after the beginning of the school year, at the
36time of that pupil’s enrollment, each school district shall notify
37the parent or guardian of each pupil about instruction in
38comprehensive sexual healthbegin delete education andend deletebegin insert education,end insert HIV/AIDS
39prevention educationbegin insert, and dating violence, sexual abuse, and sex
40trafficking prevention education,end insert
and research on pupil health

If arrangements for this instruction are made after the
24beginning of the school year, notice shall be made by mail or
25another commonly used method of notification, no fewer than 14
26days before the instruction is delivered.

27(3) Include information explaining the parent’s or guardian’s
28right to request a copy of this chapter.

29(4) Advise the parent or guardian that the parent or guardian
30may request in writing that his or her child not receive

33(b) Notwithstanding Section 51513, anonymous, voluntary, and
34confidential research and evaluation tools to measure pupils’ health
35behaviors and risks, including tests, questionnaires, and surveys
36containing age-appropriate questions about the pupil’s attitudes
37concerning or practices relating to sex may be administered to any
38pupil in grades 7 to 12, inclusive, if the parent or guardian is
39notified in writing that this test, questionnaire, or survey is to be
40administered and the pupil’s parent or guardian is given the
P8    1opportunity to review the test, questionnaire, or survey and to
2request in writing that his or her child not participate.

3(c) The use of outside consultants or guest speakers as described
4in paragraph (2) of subdivision (a) is within the discretion of the
5school district.

SEC. 8.  

Section 51939 of the Education Code is amended to

(a) A pupil may not attend any class in comprehensive

14pupil’s parent or guardian excusing the pupil from participation.

15(b) A pupil may not be subject to disciplinary action, academic
16penalty, or other sanction if the pupil’s parent or guardian declines
17to permit the pupil to receivebegin delete comprehensive sexual health
18education or HIV/AIDS prevention educationend delete

19to this chapter,end insert
or to participate in anonymous, voluntary, and
20confidential tests, questionnaires, or surveys on pupil health
21behaviors and risks.

24anonymous, voluntary, and confidential test, questionnaire, or
25survey on pupil health behaviors and risks is being administered,
26an alternative educational activity shall be made available to pupils
27whose parents or guardians have requested that they not receive
28the instruction or participate in the test, questionnaire, or survey.
