Existing law provides for the imposition of certain registration fees on motor vehicles, including certain fees imposed by local agencies for various specified purposes.
This bill would authorize a city, county, or regional park district to impose, as a special tax, a motor vehicle registration surcharge of not more than $5 for bicycle infrastructure purposes. The bill wouldbegin delete provide forend deletebegin insert requireend insert the Department of Motor Vehicles to administer the surcharge and to transmit the net revenues from the surcharge to the local agency. The bill would require the local agency to use these revenues for improvements to paved and natural surface trailsbegin insert

and bikeways and other bicycle facilitiesend insert, and for associated maintenance purposes.begin insert The bill would limit to 5% the amount of net revenues that may be used by the local agency for its administrative expenses in implementing these provisions.end insert

The people of the State of California do enact as follows:
Section 9251 is added to the Vehicle Code, to

(a) In addition to any other fees specified in this code,
4a city, county, or regional park district may impose, as a special
5tax subject tobegin insert two-thirds voter approval in the jurisdiction in which
6it is imposed, pursuant toend insert subdivision (d) of Section 2 of Article
7XIII C of the California Constitution, a local motor vehicle
8registration surcharge, in whole dollars not to exceed five dollars
9($5), on each vehicle registered within the jurisdiction of the
10agency imposing the surcharge, except vehicles that are expressly
11exempted from payment of registration fees. The amount of the
12surcharge shall be specified in an ordinance adopted by the local
13agency. The surcharge shall be administered by the department,
14
with revenues, after deduction of collection costs, to be distributed
15to the local agency, for expenditure pursuant to subdivision (b).
16(b) The net revenues from the surcharge shall be used by the
17local agency for improvements to paved and natural surface trails
18begin insert and bikewaysend insert, including the rehabilitation, restoration, and
19expansion of existing trailsbegin insert and bikewaysend insert, the development of new
20trailsbegin insert and bikewaysend insert,begin insert the improvement and development of other
21bicycle facilities, including, but not limited to, bicycle parking
22facilities,end insert
and the maintenance and upkeep of local and regional
23trailbegin delete systems andend deletebegin insert and bikewayend insertbegin insert systems,end insert networksbegin insert, and other bicycle
24facilitiesend insert.begin insert Not more than 5 percent of the net revenues may be used
25by the local agency for its administrative expenses in implementing
26this section.end insert
27(c) For purposes of this section, “regional park district” shall
28have the same meaning as “district” as defined in Section 5500 of
29the Public Resources
Code.
