An act to amend Section 13012.5 of the Penal Code, relating to criminal statistics.

Existing law requires the Department of Justice to present a report to the Governor annually containing the statewide criminal statistics of the preceding year.

This bill would require the department to also include in that report countywide criminal statistics for that periodbegin insert, and specified information regarding persons who were younger than 21 years of age at the time of their offensesend insert.begin insert The bill would require the department to post on its Internet Web site the information required by its provisions in a format that allows a user to query and download the information. The bill would delete an obsolete provision.end insert

SECTION 1.  

Section 13012.5 of the Penal Code is amended
2to read:

13012.5.  

(a) The annual report published by the department
4under Section 13010 shall, in regard to the contents required by
P2    1subdivision (d) of Section 13012, include the following statewide
2and county level information:

3(1) The annual number of fitness hearings held in the juvenile
4courts under Section 707 of the Welfare and Institutions Code,
5and the outcomes of those hearings including orders to remand to
6adult criminal court, cross-referenced with information about the
7age, gender, ethnicity,begin insert commitmentend insertbegin insert county,end insert and offense of the
8minors whose cases are the subject of those fitness hearings.

9(2) The annual number of minors whose cases are filed directly
10in adult criminal court under Sections 602.5 and 707 of the Welfare
11and Institutions Code,begin insert classified according to the manner in which
12adult court jurisdiction was initiated andend insert
cross-referenced with
13information about the age, gender, ethnicity,begin insert commitmentend insertbegin insert county,end insert
14 and offense of the minors whose cases are filed directly to the adult
15criminal court.

16(3) The outcomes of cases involving minors who are prosecuted
17in adult criminal courts,begin delete regardless of howend deletebegin insert classified according to
18the manner in whichend insert
adult court jurisdiction was initiated,begin insert andend insert
19 includingbegin insert the length of time in custody prior to disposition of the
20case,end insert
whether the minor was acquitted or convicted,begin delete orend delete whether
21the case was dismissed and returned to juvenile court,begin delete includingend delete
22begin insert andend insert sentencing outcomesbegin insert end insertbegin insertin juvenile or adult criminal courtsend insert,

and offense of the minors subject to these court actions.

25(4) The total number of people who were under 21 years of age
26at the time of their offenses who are currently committed to the
27California Department of Corrections and Rehabilitation
28cross-referenced with the age, gender, ethnicity, commitment
29county, and offense of the individuals.

30(b) The department’s annual report published under Section
3113010 shall include the information described in subdivision (d)

36information required by subdivisions (a) and (b) in a format that
37allows a user to query and download the information for the most
38recent reporting year and for prior years or reporting cycles for
39which the information is available.

4(1) The offender’s residence ZIP Code at the time of the offense.

7(e) The department shall post on its Internet Web site annually
8the number of people under 21 years of age at the time of their
9offenses who were sentenced to state prison, including those
10sentenced to state prison who were ordered to serve their terms
11in a county facility, and the number of those people who were still
12serving sentences at yearend, the offense, the sentence and
13enhancement for each offense, cross-referenced with the person’s
14age at the time of the offense, gender, ethnicity, commitment county,
15and date of offense.
