SB 1217, as introduced, Leno. State lands: land use revenue.
Existing law requires the State Lands Commission to deposit in the General Fund all revenue, money, and remittances received by the commission, with the exception of revenue derived from state school lands and other specified sources. Existing law requires that those moneys be made available, upon appropriation, for specified purposes, including refunds, commission expenses, and payments to cities and counties.
This bill would require that at least $10,000,000, but no more than $15,000,000, of those moneys be transferred each year into the Coastal Adaptation Fund, which the bill would create in the State Treasury, for use for the preservation and protection of coastal lands, subject to an appropriation for that purpose in the annual Budget Act.
Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no.
The people of the State of California do enact as follows:
Section 6217 of the Public Resources Code is

4deposit all revenue, money, and remittances received by the
5commission under this division, and under Chapter 138 of the
6Statutes of 1964, First Extraordinary Session, in the General Fund.
7Out of those funds deposited in the General Fund, sufficient
8moneys shall be made
available each fiscal year for the following
9purposes:

12appropriations made for that purpose.

15the annual Budget Act.

24(b) This section shall become operative on July 1, 2006.
