Existing law prescribes various duties for the Department of General Services in connection with development and maintenance of the park around the State Capitol building.

It would require that the planning, construction, and maintenance of the monument be funded with private donations through a nonprofit foundation to be
established.begin insert The bill would require the department to prepare a maintenance agreement outlining the responsibility of that nonprofit foundation for the long-term maintenance of the monument due to aging, vandalism, or relocation. The bill would require the department, in conjunction with the Historic State Capitol Commission and that nonprofit foundation, to approve the design, determine the location, review preliminary design plans, and review final construction documents for the monument, as provided. The bill would prohibit construction of the monument until the master plan of the State Capitol Park is approved and adopted by the Joint Committee on Rules, and the Joint Committee on Rules and the Department of Finance have determined that sufficient private funding is available to construct and maintain the memorial.end insert

The people of the State of California do enact as follows:
Section 14633 is added to the Government Code,
2to read:
(a) The departmentbegin delete shallend deletebegin insert mayend insert be responsible for the
4planning and construction of a monument in the State Capitol park
5in honor of the contributions, history, and culture of Native
6Americans in California.
7(b) The department shall determine the location of the
monument
8within the State Capitol park.
9(b) The department, in consultation with the Historic State
10Capitol Commission and the nonprofit foundation described in
11subdivision (c), shall do both of the following:
12(1) Approve the design of the monument and determine the
13location of the monument within the State Capitol Park.
14(2) Review preliminary design plans to identify potential
15maintenance concerns and to review final construction documents
16to ensure that all requirements are met.
17(c) The planning, construction, and maintenance of the
18monument shall be funded with private donations through a
19nonprofit foundation to be established.
20(d) Construction of the monument shall not begin until the
21master plan of the State Capitol Park is approved and adopted by
22the Joint Committee on Rules, and the Joint Committee on Rules
23and the Department of Finance have determined that sufficient
24private funding is available to construct and maintain the
25monument.
26(e) In planning and constructing the monument, the department
27shall ensure compliance with the federal Americans with
28Disabilities Act of 1990 (42
U.S.C. Sec. 12101 et seq.) and with
29any other safety concerns.
30(f) The department shall prepare a maintenance agreement
31outlining the responsibility of the nonprofit foundation described

2due to aging, vandalism, or relocation.
