The Local Agency Public Construction Act establishes contracting by local agencies for the construction of public works. Existing law regulates the procedures by which a begin delete local agency end delete begin insert school district end insert awards public works contracts.

This bill would require a begin delete local agency to timely post on end delete begin insert school district, at the next regular update of end insert its Internet Web begin delete site end delete begin insert site, to post on that site end insert a copy of any final public works contract awarded at a cost of $5,000 or more. By imposing an additional duty upon begin delete local governments end delete begin insert school districts end insert in the posting of begin delete local agency end delete public works contracts, this bill would impose a state-mandated local program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

The people of the State of California do enact as follows:

SECTION 1.

Contract Code, to read:

A begin delete local agency end delete begin insert school district end insert subject to this begin delete chapter end delete
begin insert article end insert that is taking bids for the construction of a public work or
improvement costing five thousand dollars ($5,000) or more begin delete shall
post, in a timely fashion, on end delete begin insert shall, at the next regular update of end insert
the begin delete local agency’s end delete begin insert school district’s end insert Internet Web site begin insert , post on that
site end insert a copy of each final contract awarded.

SEC. 2.  

If the Commission on State Mandates determines that
this act contains costs mandated by the state, reimbursement to
local agencies and school districts for those costs shall be made
pursuant to Part 7 (commencing with Section 17500) of Division
4 of Title 2 of the Government Code.
