An act to repeal Section 3701.9 of the Labor code, relating to workers’ compensation.

SB 1373, as introduced, Walters. Workers’ compensation: self-insure.

Existing law prohibits, for purposes of workers’ compensation, a certificate of consent to self-insure from being issued after January 1, 2013, to a professional employer organization, a leasing employer, a temporary services employer, or any employer which the Director of Industrial Relations determines is in the business of providing employees to other employers. A certificate of consent to self-insure that had already been issued to any of these employers shall be revoked by the director not later than January 1, 2015.

This bill would repeal the above prohibition on certificates of consent to self-insure from being issued to those employers.

SECTION 1.  

Section 3701.9 of the Labor Code is repealed.

3701.9.  

(a) A certificate of consent to self-insure shall not be
3issued after January 1, 2013, to any of the following:

4(1) A professional employer organization.

5(2) A leasing employer, as defined in Section 606.5 of the
6Unemployment Insurance Code.

P2    1(3) A temporary services employer, as defined in Section 606.5
2of the Unemployment Insurance Code.

3(4) Any employer, regardless of name or form of organization,
4which the director determines to be in the business of providing
5employees to other employers.

6(b) A certificate of consent to self-insure that has been issued
7to any employer described in subdivision (a) shall be revoked by
8the director not later than January 1, 2015.
