   An act to amend Section 488 of the Public Utilities Code, relating
to public utilities.

   AB 2605, as introduced, Nazarian. Public utilities: tariff
schedules.
   Under existing law, the Public Utilities Commission has regulatory
authority over public utilities, including common carriers, as
defined, subject to the preemptive authority of Congress pursuant to
the Commerce Clause of the United States Constitution. The Public
Utilities Act requires the tariff schedules of carriers to be
produced and made available for inspection upon the demand of any
person.
   This bill would make nonsubstantive changes to that provision.
   Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 488 of the Public Utilities Code is amended to
read:
   488.  (a) Subject to  such     any
 rules  as  the commission may prescribe, the
schedules of carriers shall be produced and made available for
inspection upon the demand of any person. The form of  every
such   a  schedule shall be prescribed by the
commission and shall conform, in the case of any common carrier
subject to federal  regulation   regulation,
 as nearly as possible to the form of schedules prescribed by
the federal Surface Transportation Board.
   (b) Subdivision (a) is not applicable to network railroad
transportation.
