BILL ANALYSIS CONFERENCE COMPLETED SB 198 Kopp (I) and Russell (R) Conference Report No. 1, 3/14/94 27 - Urgency NOT RELEVANT NOT RELEVANT NOT RELEVANT SUBJECT: High polluters SOURCE: Author ____________________________________________________________________________ DIGEST: As it left the Senate, this "committee bill" enacted several šminor changes to different codes relating to transportation, including štechnical and clarifying provisions and the repeal of obsolete provisions, šas a means of avoiding numerous single-provision bills. These provisions šwere deleted in Conference Committee. As amended in Conference Committee, this bill establishes procedures šdirected at repairing or removing high polluting vehicles from California šstreets. ANALYSIS: Existing law requires the Department of Motor Vehicles, upon šthe renewal of registration of a motor vehicle subject to a motor vehicle šsmog inspection program, to require biennially a valid certificate of šcompliance issued by a licensed smog check station. This bill would specify that the first certificate of compliance for any švehicle which is registered for the first time in this state on or after šJanuary 1, 1994, shall be required upon the second renewal of its šregistration. The bill would require the Department of Motor Vehicles, if a payment, in šthe nature of a donation, in an amount determined by the Department of š Consumer Affairs, but not to exceed $50, is made upon the initial šregistration of a new motor vehicle, to issue a certificate of exemption šfrom those requirements that would be valid for the new motor vehicle's šfirst biennial smog inspection. The certificate of exemption would be void šif title to, or any interest in, the vehicle is transferred, as specified. The Department of Motor Vehicles would be required to transmit those špayments to the Treasurer on a monthly basis for deposit in the High šPolluter Repair or Removal Account, which the bill would create in the šVehicle Inspection and Repair Fund. The bill would authorize the šDepartment of Consumer Affairs to accept donations or grants of funds from šany person for purposes of the bill, and deposit that money in the account. š The money in the account would be available, upon appropriation, to the šDepartment of Consumer Affairs to establish and implement a program for the šrepair or replacement of high polluters, as defined. The bill would require the program to provide for payment to the owner of a šhigh polluter for up to 80% of the total costs of repair, not to exceed š$450, or for the market value of a high polluter being removed, not to šexceed $800. The department would be authorized to increase those amount šlimits to reflect changes in the Consumer Price Index. The bill would also authorize the Department of Motor Vehicles to charge a šfee for the issuance of a certificate of exemption which is equal to the šfee that is charged for the issuance of a certificate of compliance. The šbill would require the department to deposit any revenue from that fee in šthe Vehicle Inspection and Repair Fund, to be available for purposes of šadministering and enforcing the vehicle inspection and maintenance program.
