BILL ANALYSIS SB 521 Date of Hearing: August 16, 1993 ASSEMBLY COMMITTEE ON TRANSPORTATION RICHARD KATZ, Chair SB 521 (Presley) - As Amended: May 25, 1993 SUBJECT Inspection and Maintenance Program DIGEST Existing law: 1) Authorizes the Department of Consumer Affairs (DCA), under certain š specified circumstances, to refuse to validate, or invalidate temporarily or permanently, the registration of an automotive repair dealer for certain acts or omissions including failure to comply with the Automotive Repair Act. If disciplinary action is pursued, the Bureau of Automotive Repair (BAR) may seek action against other BAR licenses held by the individual. 2) Authorizes the Department of Motor Vehicles (DMV) to prescribe the form š of the smog certificate of compliance or noncompliance. The current compliance certificate is issued to the vehicle owner and subsequently submitted to DMV with other registration documents. This bill: 1) Authorizes DCA to suspend or revoke the automotive repair registration š or any automotive repair license of a licensee or violates vehicle inspection (smog check) laws or regulations, or who violates lamp and brake repair provisions. 2) Provides that the smog certificate may be electronic or otherwise. 3) Makes several technical and corrective changes to obsolete references š in the Business and Professions Code related to automotive repairs. FISCAL EFFECT Unknown. COMMENTS 1) According to the author, the BAR and DMV have conducted a limited test š at smog check referee stations of the use of electronic smog certification - continued - SB 521 Page 1 SB 521 information techniques and equipment. They now believe that a "paperless šcertificate" is feasible. 2) This bill may be amended and used to carry provisions of a negotiated š settlement in the Inspection and Maintenance (I/M) program.
