  SUMMARY  

Prohibits the unauthorized use of electronic mail networks and  
provides specified penalties.  Specifically,  this   bill  :  

1. Seeks to limit the practice of sending unsolicited e-mail  
   advertisements, by clarifying that e-mail service providers  
   control the use of their services.  

2.  Prohibits an individual, corporation or a registered owner of  
an e-mail service provider from using the provider's equipment in  
violation of the provider's published policy.

3.  Provides that an e-mail service provider, whose published  
policy is violated, may recover monetary loss.

4.  Prohibits the unauthorized use of computer domain names by  
adding domain name forgery to the list of computer crimes  
punishable as a wobbler, by a fine up to $10,000 and/or  
imprisonment for up to three years.

  FISCAL EFFECT  

Minor nonreimbursable state and local law enforcement and  
incarceration costs as no one was admitted to state prison in 1997  
for a violation of Penal Code Section 502.
 
  BACKGROUND  

  Rationale  .  According to the author's office, this bill is  
intended to help internet service providers stop internet spamming  
and domain fraud by allowing electronic service providers to adopt  
policies restricting its use, and criminalizing domain name use.
