    An act to amend Sections 50661 and 50740 of, and to add
Part 11 (commencing with Section 53500) to Division 31 of, the Health
and Safety Code, relating to financing housing programs by providing
the funds necessary therefor through the issuance and sale of bonds
of the State of California and by providing for the handling and
disposition of those funds.   An act relating to
property acquisition, and making an appropriation therefor.

   AB 398, as amended, Migden.   Housing Bond Act of 2000
  Property acquisition  . 
   Existing law requires the Wildlife Conservation Board to authorize
the acquisition of real property, rights in real property, water, or
water rights as necessary to carry out the purposes of the Wildlife
Conservation Law of 1947.
   This bill would require the board to authorize the acquisition of
property in San Francisco Bay currently owned by the Cargill Salt
Division, upon the performance of conditions prescribed in the bill.

   The bill would appropriate a sum not to exceed $150,000,000 from
the General Fund to the Wildlife Restoration Fund for the acquisition
of the property.  
   Under existing law, there are programs providing assistance for
the rehabilitation of existing housing, the development of, and
assistance for, low-income rental housing, the construction or
rehabilitation of farmworker housing, and assistance for first-time
homebuyers.
   This bill would enact the Housing Bond Act of 2000 which, if
adopted, would authorize, for purposes of financing those existing
housing programs and for additional specified housing purposes, the
issuance of bonds in an amount up to $750,000,000 pursuant to the
State General Obligation Bond Law.
   The bill would provide that notwithstanding any other provision of
the bill, no fund shall be created and no bonds shall be issued or
sold pursuant to the bill, no appropriation shall be made in the bill
for any purpose, no portion of the bill shall be submitted to the
voters, and nothing in the bill shall create any debt or liability of
the state.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  
  SECTION 1.  Section 50661 of the Health and Safety  
  SECTION 1.  The Legislature finds and declares that it is desirable
to restore and enhance the significant area of former marshland and
wildlife habitat in San Francisco Bay currently owned by the Cargill
Salt Division.
  SEC. 2.  (a) A sum not to exceed one hundred fifty million dollars
($150,000,000) is hereby appropriated from the General Fund to the
Wildlife Restoration Fund for the acquisition by a state agency, or
state and federal agency, of approximately 19,000 acres of salt
ponds, or portion thereof, in San Francisco Bay currently owned by
the Cargill Salt Division.
   (b) "Cargill property," for purposes of this section, means the
19,000 acres owned by the Cargill Salt Division that Cargill proposes
to sell to the state and federal governments.
   (c) The moneys appropriated pursuant to this section shall not be
released for the acquisition of the property until all of the
following conditions are met:
   (1) The purchase price for the Cargill property, or portion
thereof, shall not exceed the fair market value of the property, or
portion thereof, as determined by an appraisal pursuant to Section
1348.2 of the Fish and Game Code.
   (2) A matching federal appropriation for the acquisition of the
Cargill property, or portion thereof, shall be deposited into an
account established solely for the acquisition of the Cargill
property or a portion thereof.
   (3) The Wildlife Conservation Board shall authorize the
acquisition of the Cargill property, or portion thereof, pursuant to
Section 1348 of the Fish and Game Code, except that the board shall
not make the authorization until the board has identified funds for
the preparation and implementation of a restoration plan for the
Cargill property.    _____________________________________
