SUMMARY :
This bill revises the funding formula for adults in local
correctional facilities. Specifically, this bill allows a
district to use an enrollment figure based on the highest
average daily attendance authorized during any of the last five
fiscal years, multiplied by 1.25, unless the Legislature
approves a greater increase in the annual Budget Act.
FISCAL EFFECT :
Unknown GF (Prop 98) costs, potentially over $1.4 million to
allow school districts to claim a higher calculation for funding
for adults in correctional facilities, when such facilities
decline in enrollment.
COMMENTS :
1)Purpose . The author contends this bill protects counties' jail
education program so that the temporary closing and remodeling
of jails can be accommodated from year to year without
reduction to education programs. The author states that the
1998-99 Budget Act provided $15.6 million to reimburse local
agencies for providing adult education to inmates in county
correctional facilities, while only $14.2 million was
allocated by the State Department of Education for this
purpose. This discrepancy was due to the temporary closure of
facilities for renovations and administrative reasons. Current
reimbursements are capped at a certain percentage. When
facilities reopen, the increase in adults served in the
educational programs exceeds the cap.

2)Current Funding Formula . Existing law prohibits any increase
to the ADA for adults in correctional facilities unless the
Legislature approves such increases in the annual budget.
