BILL SUMMARY:  AB 1001 amends the California Fair  
Employment and Housing Act to include protections against  
discrimination based on sexual orientation, and moves the  
provisions prohibiting employment discrimination on the  
basis of sexual orientation from the Labor Code to the Fair  
Employment Housing Act (FEHA). 

AB 1001 provides Legislative Intent that this bill is not  
intended to alter the definition of employer with regard to  
any bona fide scouting organization covered under Section  
1102.1 of the Labor Code.

Costs result from an increase in filings anticipated due to  
increasing the filing time period from 30 days to one year.

Labor Code Section 1102.1 prohibits employment  
discrimination based on sexual orientation.  Under this  
code section, there is a 30 day statutory period in which  
to file discrimination cases.  However, all nonprofit  
organizations are exempted from this Section.    AB 1001  
moves this employment prohibition to FEHA which allows for  
one year to file a claim.  Staff notes that only nonprofit  
  religious  organizations are exempted from FEHA.

This bill is similar to AB 257 (Villaraigosa) which was  
vetoed by the Governor last session.
