BILL SUMMARY:
AB 1197 would require that a person, including an alien
precluded from establishing California residency because of
federal law, who meets certain eligibility requirements, be
exempted from paying nonresident tuition at the California
Community Colleges or the California State University. The
bill would request the Regents of the University of
California to also exempt these persons from paying
nonresident tuition.

STAFF COMMENTS:
This bill meets the criteria to be placed on the Suspense
file.
To be exempt from nonresidential tuition requirements, a
person must meet the following:
1)Graduation from a California high school.
2)Continuation of his or her education at a CSU or CCC
within one year of high school graduation or on or before
January 1, 2001.
3)Filing of a petition or application for lawful
immigration status.
Currently, nonresident tuition at CSU is $8,118 for two
semesters. Resident tuition is $2,856 for two semesters
beginning Fall, 1999. Nonresident tuition at CCCs is
$3,500. Resident tuition is $12.00 per unit.
It is unknown at this time how many students would be
affected by this bill but it appears that between 750 and
1,500 students may enroll in CSU under the provisions of
the bill. For the purposes of estimating some fiscal
impact, 1,125 students paying resident tuition would
generate $3,213,000 annually. The same number of students
paying nonresident tuition would generate $9,132,750 or a
difference of $5,919,750. However, it is highly unlikely
the same number of students would enroll if they were
required to pay the nonresident tuition.
