Summary : Makes changes to the California Work Opportunity and
Responsibility to Kids (CalWORKs) program. This is one of the
social services Budget trailer bills.
The Senate amendments delete the Assembly version of this bill
and instead:
1)Allow counties to provide CalWORKs services that will assist
individuals to obtain or retain unsubsidized employment to
individuals that would otherwise be eligible for CalWORKs but
who have been convicted of any offense classified as felony
possession or use of a controlled substance.
2)State that, in order to be eligible, individuals must meet all
of the following requirements:
a) The individual must have custody of dependent children
under the age of 18 years and must be living with them;
b) The individual must either have a job or be determined
by the county as being employable if supportive services
are provided;
c) The individual must not be using a controlled substance
at the time of application;
d) At least five years must have elapsed since the
individual fulfilled the condition imposed by the court in
the disposition of the criminal case;
e) The individual must have successfully completed, or be
currently participating in, or be willing to enroll in a

drug treatment program as a condition of receiving
services;
f) The duration of services is limited to no more than 18
months; and,
g) The individual must submit to and pass monthly medical
drug screening tests.
AS PASSED BY THE ASSEMBLY this bill established the Intervention
Probation and Parole Partnership Act.
Fiscal Effect : Unknown
Comments : This bill was substantially amended and passed by the
Senate for purposes of using the bill as a vehicle for a social
services Budget trailer bill. The Assembly did not concur in
the Senate amendments in order to allow for further amendments
by the Senate to make technical changes and to clarify that the
individuals who would be eligible for CalWORKs services are
those convicted of any offense classified as felony possession
or use of a controlled substance.
