An act to add Section 12802.6 to the Vehicle Code, relating to
vehicles.

AB 2574, as introduced, Briggs. Vehicles: driver's license:
selective service registration.
Existing law requires every applicant for an original or a renewal
of, a driver's license to provide appropriate information concerning
identification, personal history, health, knowledge of traffic signs
and signals, and the type of motor vehicle the applicant desires to
operate. Existing federal law, the Military Selective Service Act,
requires certain males residing in the United States to register in
accordance to rules and regulations adopted in accordance with
federal law. Existing law also requires all state agencies to
cooperate with the United States Selective Service System to
publicize the necessity of, and the requirements for compliance with
the federal act.
This bill would require the Department of Motor Vehicles to
require a male applicant between 18 and 26 years of age, inclusive,
with certain exceptions, for an original or a renewal of, a driver's
license to sign a certificate of compliance that he has complied with
the provisions of the federal act as a prerequisite to obtaining a
driver's license. The bill would also require the department to
develop the certificate of compliance and applicable implement
procedures.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 12802.6 is added to the Vehicle Code, to read:
12802.6. (a) Notwithstanding any other provision of law, the
department shall require every applicant for an original or a renewal
of, a driver's license who is male and 18 to 26 years of age,
inclusive, to sign a statement that he has complied with the federal
Military Selective Service Act (50 U.S.C. Sec. 451 and following)
prior to the issuance of a driver's license.
(b) The department may not issue an original or renewal of, a
driver's license to any person not satisfying the provisions of
subdivision (a).
(c) The department shall develop a statement of compliance and a
method by which an applicant as set forth in subdivision (a) shall
have an opportunity to sign the statement of compliance and for the
signed statement of compliance to become part of the applicant's
application for a driver's license.
(d) This section is not applicable to any of the following:
(1) A person who is presently in, or has been discharged from, the
armed forces of the United States.
(2) A person who is neither a citizen of the United States nor a
resident alien.
(3) Exempt from registering under the Military Selective Service
Act.
(4) Exempt because the act is otherwise inapplicable to the
applicant for any other reason.
(e) The burden is upon the applicant to provide proof of
qualifying for an exception under the provisions of subdivision (d).
