   An act to amend Section 1653.5 of, and to add Section 1678 to, the
Vehicle Code, relating to vehicles.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 2574, as amended, Briggs.  Vehicles:  driver's license:
selective service registration.
   Existing law requires every applicant for an original or a renewal
of, a driver's license to provide appropriate information concerning
identification, personal history, health, knowledge of traffic signs
and signals, and the type of motor vehicle the applicant desires to
operate.  Existing federal law, the  federal  Military
Selective Service Act, requires certain males residing in the United
States to register in accordance to rules and regulations adopted in
accordance with federal law.  Existing law also requires all state
agencies to cooperate with the  United States  
federal  Selective Service System to publicize the necessity of,
and the requirements for compliance with the federal act.
   This bill would require the Department of Motor Vehicles, for
every applicant between 18 and 25 years of age, inclusive, with
certain exceptions, for an original or a renewal of, a driver's
license or identification card to provide the applicant, at the time
of application, with notification that males 18 to 25 years of age,
inclusive, are or will be required to be in compliance with the
federal act and that if the applicant is male and is not already
registered with the  federal  Selective Service
System, the applicant  may register with the service by
checking an appropriate box on the application   would
acknowledge that by his application he will be registered with the
Selective Service System.  The bill would inform the applicant that
he may contact the Selective Service System in writing, and request
that his name be removed from the registry  .  The bill would
also require the department, if federal financial support is
provided, and in cooperation with the  federal selective
service system   Selective Service System  , to
develop the notification form and applicable implementation
procedures.  The bill would make a related statement of legislative
intent.
   The bill would make other, conforming changes in existing law.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:


  SECTION 1.  (a) It is the intent of the Legislature in enacting
this act to protect Californians from the penalties associated with
the failure to register with the federal Selective Service System and
to help ensure that any future draft is fair and equitable to all
potential draftees.
   (b) The Legislature finds and declares that the penalties
associated with noncompliance of the Military Selective Service Act
(50 U.S.C. Sec. 451 and following) are severe, including, but not
limited to, a felony conviction, forfeiture of the ability to seek
state employment from certain state agencies and departments, and a
fine of up to two hundred fifty thousand dollars ($250,000).  In
addition, failure to register may permanently preclude the violator
from acquiring many federal benefits, such as federal employment,
including, but not limited to, employment with the United States
Postal Service, federal and state student financial assistance,
participation in federally funded job training programs, and
eligibility for United States citizenship for immigrants seeking
citizenship.
   (c) Therefore, in recognition of the severe consequences of
noncompliance with the federal act and the importance of helping to
ensure that any future draft is fair and equitable, it is the intent
of the Legislature to notify Californians of their responsibility to
register with the federal Selective Service System and to provide
them with the opportunity to register concurrent with applying for a
driver's license or identification card.
  SEC. 2.  Section 1653.5 of the Vehicle Code is amended to read:
   1653.5.  (a) Every form prescribed by the department for use by an
applicant for the issuance or renewal by the department of a driver'
s license or identification card pursuant to Division 6 (commencing
with Section 12500) shall contain a section for the applicant's
social security account number.
   (b) Every form prescribed by the department for use by an
applicant for the issuance, renewal, or transfer of the registration
or certificate of title to a vehicle shall contain a section for the
applicant's driver's license or identification card number.
   (c) Any person who submits to the department a form that, pursuant
to subdivision (a), contains a section for the applicant's social
security account number, or pursuant to subdivision (b), the
applicant's driver's license or identification card number, if any,
shall furnish the appropriate number in the space provided.
   (d) The department shall not complete any application that does
not include the applicant's social security account number or driver'
s license or identification card number as required by subdivision
(c).
   (e) An applicant's social security account number shall not be
included by the department on any driver's license, identification
card, registration, certificate of title, or any other document
issued by the department.
   (f) Notwithstanding any other provision of law, information
regarding an applicant's social security account number, obtained by
the department pursuant to this section, is not a public record and
shall not be disclosed by the department except for any of the
following purposes:
   (1) Responding to a request for information from an agency
operating pursuant to, and carrying out the provisions of, Part A
(Aid to Families with Dependent Children), or Part D (Child Support
and Establishment of Paternity), of Subchapter IV of Chapter 7 of
Title 42 of the United States Code.
   (2) Implementation of Section 12419.10 of the Government Code.
   (3) Responding to information requests from the Franchise Tax
Board for the purpose of tax administration.
   (4) Registration with the federal Selective Service System in
compliance with the Military Selective Service Act (50 U.S.C. Sec.
451 and following).
  SEC. 3.  Section 1678 is added to the Vehicle Code, to read:
   1678.  (a) Notwithstanding any other provision of law, for every
applicant for an original or a renewal of a driver's license or
identification card who is 18 to 25 years of age, inclusive, the
department shall provide the applicant, at the time of application,
with notification of both of the following:
   (1) That males 18 to 25 years of age, inclusive, are or will be
required to be in compliance with the federal Military Selective
Service Act (50 U.S.C. Sec. 451 and following).
   (2) That if the applicant is male and is not already registered
with the federal Selective Service System, the applicant  may
register with the service by checking an appropriate box on the
application.   acknowledges that by applying for a
driver's license or an identification card, he will be registered by
the federal Selective Service System and will be in compliance with
the federal Military Selective Service Act.
   (3) If the applicant does not want to be registered as required by
federal law, he may contact the federal Selective Service System in
writing, and request that his name be removed from the registry;
however, a person otherwise required to register who fails to
register is subject to federal prosecution and is not eligible for
certain programs and benefits linked to the registration requirement.

   (b) If federal financial support is provided, the department, in
cooperation with the federal Selective Service System, shall develop
forms and procedures for the implementation of subdivision (a).
   (c) Subdivision (a) is not applicable to a person who is exempt
from the Military Selective Service Act for any reason.
