CONCURRENCE IN SENATE AMENDMENTS

SUMMARY : Creates a mechanism for allocation of savings realized
in the implementation of specified state-mandated local
programs.
The Senate amendments :
1)Limit the Savings Allocation Program (SAP) to two mandates:
a) Services to Handicapped Children; and, b) Child Abduction
and Recovery.
2)Require the State Controller (Controller) to report to the
Legislature on or before January 1, 2006, on the amount of
savings realized through SAP.
3)Sunset SAP on January 1, 2007, barring prior legislative
action that deletes or extends it.
4)Delete the provision delaying the operative date of the
program until January 1, 2003.
EXISTING LAW :
1)Requires the state to reimburse local agencies and school
districts for costs incurred in the implementation of
state-mandated programs.
2)Establishes procedures for local agencies and school districts
to file claims with the Commission on State Mandates for
reimbursement of state-mandated costs.
AS PASSED BY THE ASSEMBLY , this bill:
1)Authorized local agencies and school districts filing claims

for reimbursement for state-mandated local costs to submit
findings to the Controller identifying savings realized as a
result of efficiencies by the agency or district in
implementation of the state-mandated program.
2)Required the Controller to allocate those savings on the basis
of up to one-third each to the local agency or school
district, and the balance to the General Fund (GF).
3)Established SAP, that will develop administrative procedures
in accordance with the Administrative Procedures Act.
4)Limited SAP to GF savings of actual cost mandates.
5)Became operative on January 1, 2003.
FISCAL EFFECT : Minor costs, possibly offset in whole or part by
savings.
COMMENTS : Negotiations between the author, the Controller, and
interested parties have resulted in a bill that is considerably
more narrow in its application than the one passed by the
Assembly.
