  SUBJECT  :    Local Government Omnibus Act of 1999

  DIGEST  :    This bill enacts the Local Government Omnibus  
Act of 1999, and makes clarifying and minor  
non-controversial changes to local government law.  (See  
analysis for specifics.)

  1.Make this a fiscal bill and an urgency measure.

3.Specify that burglar bars and safety release mechanisms  
  are for emergency escape and rescue windows or doors.

4.Require this bill's regulations be adopted by January 1,  
  2000, and prohibit against use of unapproved items on  
  July 1, 2000.

5.Make numerous additional clarifying and minor,  
  non-controversial changes regarding various local  
  government issues, the bulk of which correct erroneous  
  cross-references in the Government Code pertaining to  
  county treasurer candidate qualifications, historical  
  landmark acquisitions, city and county planning reports,  
  the Permit Streamlining Act, and the Subdivision Map Act.

  ANALYSIS  :    Each year local officials discover problems  
with the state statutes that affect counties, cities,  
special districts, and redevelopment agencies, as well as  
the laws on land use planning and development.  These  
problems are relatively minor and do not warrant separate  
(and expensive) bills.  According to the Legislative  
Analyst, the cost of producing a bill is about $14,000.

The Senate Local Government Committee responds by combining  
several of these minor topics into an annual "omnibus  
bill."  For example, the committee's 1998 omnibus bill was  
SB 1649 which contained 23 noncontroversial statutory  
changes, saving over $300,000 in legislative costs.   
Although this practice may violate a strict interpretation  
of the single-subject and germaneness rules expressed in  
  Harbor v. Deukmejian  , it is an expeditious and relatively  
inexpensive way to respond to multiple requests.

This bill, among its many provisions, would:

1.Require county treasurers, county tax collectors and  
  county treasurer-tax collectors to meet specified  
  qualifications for holding office.

2.Permit a county auditor, upon agreement with the county  
  treasurer, to file a monthly written report with the  
  county board of supervisors on monies received and  
  disbursed.

3.Add specified continuous education courses to the list of  
  acceptable courses required for a county treasurer,  
  county tax-collector or county treasurer-tax collector to  
  complete at specified associations or institutions.

4.Eliminate the September 1 reporting deadline for county  
  officials to report on a county's Citizen's Option for  
  Public Safety (COPS) expenditures, and instead require  
  the report to be submitted on or before the public  
  hearing on spending requests.

5.Allow a specified sanitation district to participate on  
  the committee to select a special district representative  
  to serve on the Board of Directors of the Ventura  
  Regional Sanitation District.

6.Insert into the Revenue and Taxation Code, the Vehicle  
  License Fee (VLF) subvention language for Ventura County  
  to cover the county's cost of shifting property tax  
  revenue shifted to no and low property tax cities within  
  the county.

7.Specifies that the burglar bars and safety release  
  mechanisms are for emergency escape/rescue windows or  
  doors, and requires that the regulations be adopted on or  
  before January 1, 2000, and provides that the prohibition  
  against unapproved items commences on July 1, 2000.

8..Express the Legislature's intent to cut costs by  
  combining several local government items into a single  
  bill.

  ARGUMENTS IN SUPPORT  :    According to Senate Local  
Government Committee analysis, this bill collects  
noncontroversial changes to the state laws affecting local  
agencies, land use, and redevelopment issues into a single  
bill.  Sending a bill through the legislative process costs  
about $14,000.  By avoiding many other bills, this bill  
saves California's taxpayers about $168,000.  Although the  
practice may violate a strict interpretation of the  
single-subject and germaneness rules, the Senate Local  
Government Committee insists on a very public review of  
each item.  Should any item in this bill attract  
opposition, the committee will delete it from the bill.   
There is no hidden agenda.
